Kapil Sibal calls Amit Shah’s Bail Statement to Kejriwal “Objectionable.”

Rajya Sabha MP Kapil Sibal on Thursday hit out at Home Minister Amit Shah over his reported “special treatment” remarks on the interim bail to Delhi Chief Minister Arvind Kejriwal, saying it was an “objectionable statement” that questioned the intention of the Supreme Court judges.

Sibal’s remarks came after Shah while referring to the interim bail granted by the Supreme Court to Kejriwal, reportedly said many in the country believed he was given special treatment.

The Supreme Court on Thursday steered clear of the political talk about it has made an exception for Kejriwal in granting him interim bail for campaigning in the Lok Sabha polls but said: “critical analysis of the judgment is welcome”.

Addressing a press conference in the national capital, Sibal said, “Shah has made an objectionable statement and questioned the intention of the Supreme Court judges.”
Shah has stated very cleverly that many people are saying the Supreme Court’s decision to grant interim bail to Kejriwal in the excise policy case is akin to him getting special treatment, he added.

“He (Shah) has said ‘people are saying’. If people are saying and you don’t believe in it, then why say it? If people say and you believe it, then only you have made the statement,” said Sibal, who is also a senior advocate.

Sibal said it is important to spell out the laws in light of the statement.

“If someone is convicted but gets a stay from the court, he or she can file a nomination and get elected. If there is a charge sheet against anyone, a person can campaign and also file a nomination, like Brij Bhushan Sharan Singh is doing,” the Rajya Sabha MP said.

“One who just has allegations against him cannot campaign, what kind of a statement is this?” Sibal said, hitting out at Shah.

He probably does not know the law, otherwise he would not have made the statement, Sibal said.

Slamming Shah, Sibal said, “He (Shah) says ‘if we win 400 seats, we will take back PoK’. What if you don’t get that many seats, won’t you take back PoK? We want you to take it back. Firstly, you should take back those 4,000 kilometers that China has taken away…”
Asked about the alleged assault on AAP MP Swati Maliwal at Kejriwal’s residence, Sibal said, “Why is he (Shah) worried about this (Maliwal assault case)? It’s an internal matter of AAP. You think about Prajwal (Revanna), why don’t you give statements on that? That is the internal matter of JD(S), you are silent there and the prime minister is also silent.

About the bogus video case involving Union Minister and Bharatiya Janata Party (BJP) leader Amit Shah, the Delhi Police has called Telangana Chief Minister and Congress leader Revant Reddy, according to ANI. The Congressman has been called to appear with his cell phone before the Delhi Police’s IFSO unit (Cyber Unit) on May 1.

According to the Delhi Police, a special cell has filed a formal complaint (FIR) over the distribution of a manipulated video of Union Home Minister Amit Shah’s speech on quota concerns across various social media platforms.

The Indian Cybercrime Coordination Centre (I4C), a division of the Ministry of Home Affairs, reportedly filed a complaint regarding Shah’s doctored video, which altered his remarks to appear as though he was supporting the elimination of all reservations. This led to the police filing a First Information Report (FIR), according to PTI.

According to the police, the case has been filed under section 66C of the Information Technology Act, section 153A of the Indian Penal Code (IPC), section 465 (forgery), section 469 (forgery to harm the reputation of any party), and section 171G (publishing false statement with intent to affect the result of an election). Section 153 (wantonly causing provocation to cause riot) and section 465 (forgery) of the Indian Penal Code (IPC) are the applicable sections.

Meanwhile, Assam Chief Minister Himanta Biswa Sarma informed that a man, Reetom Singh was arrested in connection with the fake video involving Union Home Minister Amit Shah.

The ‘doctored’ video

The Ministry of Home Affairs had earlier written in the complaint that it has been found that some doctored videos are being circulated by users of Facebook and Twitter.

The video seems to be doctored spreading misleading information to create disharmony among communities which is likely to affect public tranquility and public order issues, the MHA added.

Rahul Gandhi ‘taken into custody for 30-45 minutes’ in defamation case, gets bail, says lawyer!

Congress leader Rahul Gandhi was on Tuesday granted bail by the Sultanpur court in a 2018 defamation case filed by BJP leader Vijay Mishra for the former’s remarks against home minister Amit Shah. The court took him into custody for 30-45 minutes, said his lawyer.

Speaking about Rahul’s bail advocate Santosh Pandey said, “He (Rahul Gandhi) surrendered in the court today. He surrendered and the court took him into custody for 30-45 minutes. After that, his bail application was submitted and was accepted (by the court)… The further date has not been given yet. His lawyer said that he is innocent and he has not made any defamatory statement…”.

Pandey further said that Rahul Gandhi could be given a maximum punishment of 2 years if sufficient evidence was found against him. Rahul was granted bail by Judge Yogesh Yadav after filling bail bonds.

The defamation case was filed against Congress leader Rahul Gandhi for allegedly making objectionable comments against Shah at a press conference in Bengaluru on May 8 that year. Amit Shah was the BJP president when Gandhi made the remark. Rahul Gandhi attacked the BJP and said that the party claimed to believe in honest and clean politics but has a party president who is an “accused” in a murder case.

Reacting to the development Mishra told ANI,”I was the vice president of BJP when this incident happened. Rahul Gandhi had accused Amit Shah in Bengaluru that he is a murderer. When I heard these allegations, I felt very pained because I am a 33-year-old worker of the party. I filed a complaint regarding this through my lawyer and this continued for almost 5 years…”

“The BJP is the biggest party of the country. Calling its (then) president a murderer is unjustifiable,” he added.
