Congress is on high alert amid a dispute over remarks made by Sam Pitroda.

Additionally, Mr. Pitroda stepped out to clarify that he made the comments in his own capacity. The remarks were misrepresented, he continued, “to divert attention from what lies PM is spreading about the Congress manifesto.” This was regrettable.

“I just brought up the US inheritance tax as an example in my regular TV chat. Is it forbidden for me to state the facts? I mentioned that these are the kinds of topics that people need to talk about and argue. This is unrelated to any party’s or Congress’s policies,” he declared. “Who declared that 55% would be removed? Who declared that such a thing ought to be carried out in India? Why is the media and BJP so terrified?

The Indian Overseas Congress leader, Mr. Pitroda, stated that the prime minister believes the Indian public is easily fooled and manipulable.

“This is not how a prime minister would talk. I mistakenly believed that the video was produced by AI. PM believes that the Indian public is gullible and easily swayed. The law does not exempt him. Congress’s manifesto is incredibly well-written. to declare that they are going to take your mangalsutra and gold. You are inventing your own narratives. I believe that dread may be to blame, as panic started to set in after the first stage. The PM’s remark has infuriated India,” he declared.

He stated that the Congress has consistently prioritized the underprivileged, including OBCs, Muslims, Dalits, and tribal people. Billionaires don’t require our assistance. Our assistance is required by the impoverished. Over the past ten years, inequality has significantly worsened, he claimed.

“This does not imply that you will give away your fortune to someone. This refers to the need to develop new laws in order to stop wealth concentration. It resembles the Monopoly Act, he remarked.

He then gave an American example. “There is an inheritance tax in the United States. If a person is worth $100 million USD, the government will likely take about $55% of his money, leaving just around 45% for his offspring to inherit. What a fascinating law that is. It says that because you are leaving your generation and have amassed fortune, you must leave half of your wealth—not all of it—to the public, which seems fair to me,” he remarked.

It is important to note that there is no federal inheritance tax in the United States. Inheritable assets are subject to taxes in a few states, including Pennsylvania, Iowa, Kentucky, Maryland, Nebraska, and New Jersey. The amount of the inheritance and the deceased person’s relationship determine how much tax is due. This tax can reach about 20% of the inheritance and is only applied beyond a specific level.

According to Mr. Pitroda, this is a matter of policy. The Congress party would present a plan that would improve wealth distribution. In India, there is no minimum wage. The distribution of wealth would occur if the nation established a minimum wage that required people to give the poor a certain amount of money. Rich people today underpay their housekeepers, peons, and servants in favor of taking vacations in Dubai and London, the speaker claimed.

BJP Steps Up Its Attack

The BJP, not one to back down in the midst of an election, took Mr. Pitroda’s comments as an opportunity to intensify their criticism of the Congress. Mr. Shah, the attack’s leader, pleaded with the public to consider Mr. Pitroda’s comments carefully. “Their long-ago schemes have been revealed. Folks ought to pay attention. Additionally, the Congress ought to remove the reference to the survey from its manifesto,” he stated. “Minorities are not our first priority. Poor people, Dalits, tribal people, and underprivileged groups are our top priorities,” he continued.

A video of the interview was tweeted by Himanta Biswa Sarma, the senior BJP leader and chief minister of Assam, with the caption, “Family Advisor is spilling the beans – their intention is ‘organised loot and legalised plunder’ of your hard-earned money.”

Renowned jurist Fali S Nariman passes away at the age of 95!

Nariman received the Padma Bhushan in January 1991 and in 2007 he was awarded the Padma Vibhushan.

Renowned constitutional jurist and senior Supreme Court advocate Fali S Nariman passed away at the age of 95 in New Delhi on Wednesday.

In November 1950, Nariman became an advocate of the Bombay High Court, later earning the designation of senior advocate in 1961. With over 70 years of legal practice, he initially worked in the High Court of Bombay before shifting to New Delhi in 1972 to practice in the Supreme Court of India. Additionally, he served as Additional Solicitor General of India from May 1972 onwards, following his move from Bombay to Delhi.

The veteran lawyer was also the President of the Bar Association of India from 1991 to 2010.

Nariman received the Padma Bhushan in January 1991 and in 2007 he was awarded the Padma Vibhushan.

The veteran argued numerous significant cases, such as the NJAC verdict and the SC AoR Association case, which influenced the establishment of the collegium system. He also participated in cases like the TMA Pai case, addressing the extent of minority rights under Article 30. Notably, in June 1975, Nariman resigned as the Additional Solicitor General of India in opposition to the declaration of emergency by the Indira Gandhi government.

He served as the President of the International Council for Commercial Arbitration from 1994; the Vice-Chairman of the Internal Court of Arbitration of the International Chamber of Commerce from 1989; and also the Chairman of the Executive Committee of the International Commission of Jurists in Geneva from 1995 to 1997; among several other prominent posts.

Nariman was a significant public voice in the country. Recently, he raised criticism against the judgement leading to the abrogation of Article 370.

In 2022, Nariman in his book, ‘You Must Know Your Constitution’, wrote, “The life of a written Constitution—like the life of the law—is not logic (or draftsmanship), but experience. Seventy-odd years of experience on this subcontinent has shown that it is easier to frame a Constitution than to work it….We will never be able to piece together a new Constitution in the present day and age simply because innovative ideas however brilliant and howsoever encouragingly expressed in consultation papers and reports of commissions, can never give us an ideal Constitution.”

He also spoke to HT, about the sedition law saying, “I am simply alarmed (and dismayed) by sedition remaining a part of the new law since it was always an oppressive colonial law that demanded not just mere obedience from the citizens to the orders of a foreign government but also insisted on citizens having an ‘affection’ for it. So when Gandhi ji was charged with sedition (as I have related in the book), he readily agreed and pleaded guilty to the charge since he had no ‘affection’ at all for the Government!”
