Delhi Woman gets 6 months jail

A Delhi Court sentenced a woman to six months in jail for not filing a return on income of ₹2 crores after a complaint was filed by the Income Tax Office (ITO) alleging that TDS (tax deducted at source) amounting to Rs. 2 lakh was deducted against the receipt of ₹2 crore made to the accused during 2013-14, but no return of income was filed. The court sentenced Savitri noting, “The convict is awarded a sentence of simple imprisonment for six months with a fine of ₹5,000 and in default to undergo simple imprisonment for one month.”

While Savitri’s lawyer argued that she is an uneducated widow and has no one to take care of her after which the court granted her 30 days’ bail to challenge the order.

The court noted that the complainant was able to prove beyond reasonable doubt that notices were issued to the accused owing to which she was bound to file a return of income which was admittedly not filed by the accused.

“Accordingly, the accused is held guilty of not filing the return of income for the assessment year 2014-15 under Section 276CC of The Act. Accordingly, the accused is convicted for an offence punishable under Section 276CC of the Act,” the court said in the judgement.

CAA Rules Notified: BJP fulfils another promise made in 2019 poll manifesto!

The BJP expects to reap dividends from the announcement made on Monday in Assam, Punjab and West Bengal.

CAA Rules Notified

The Bharatiya Janata Party (BJP) has fulfilled yet another promise made in its 2019 election manifesto with the notification of the rules for the implementation of the Citizenship Amendment Act (CAA) ahead of the upcoming Lok Sabha polls that will set in motion the process of fast-tracking citizenship rights for persecuted minorities from the neighbourhood.

“The Modi government today notified the Citizenship (Amendment) Rules, 2024. These rules will now enable minorities persecuted on religious grounds in Pakistan, Bangladesh and Afghanistan to acquire citizenship in our nation. With this notification PM Shri @narendramodi Ji has delivered on another commitment and realised the promise of the makers of our constitution to the Hindus, Sikhs, Buddhists, Jains, Parsis and Christians living in those countries,” Union home minister Amit Shah posted on X (formerly Twitter) shortly after the announcement.

The BJP expects to reap dividends from the announcement made on Monday in Assam, Punjab and West Bengal. In West Bengal, where the Matua community counted among Scheduled Castes migrated from Bangladesh mainly because of religious persecution, the government promised the implementation of CAA to placate the community that has been on the fringes of economic and social growth.

The party is also hoping to earn support from Sikhs who migrated to India from Afghanistan and about 500 Hindu families who have arrived in batches from Pakistan and are spread over Delhi and Rajasthan. There is no data on how many families will benefit from the law. The government stated in Parliament in 2019 that 1,595 Pakistani and 391 Afghan migrants of all religions have been granted Indian citizenship between 2016 to 2018.

“Provision for capturing online citizenship data of migrants from minority communities namely Hindu, Sikh, Buddhist, Jain, Parsi and Christian hailing from Afghanistan, Pakistan and Bangladesh was introduced in 2018. As per the available data, 295 Hindus and Sikhs from Afghanistan and Pakistan have been granted Indian Citizenship since then,” Union minister Kiren Rijiju has said in a written reply.

Apart from the commitment to construct a Ram Temple and remove the provisions of Article 370 from Jammu and Kashmir, which gave the erstwhile state special status, the party’s election manifesto spelt out the BJP’s commitment for giving Hindus, Jains, Parsis, Buddhists, Christians and Sikhs, who were persecuted in countries such as Pakistan, Afghanistan and Bangladesh a place in India and the rights to become a citizen. It will benefit who entered India on or before December 31, 2014.

The party has met all three promises, although the pending promise of implementing a uniform civil code is being implemented by separate BJP-ruled states. While the Bill to read down Article 370 was passed in Parliament in August 2019, the consecration of the Ram temple took place on January 25.

“We are committed to the enactment of the Citizenship Amendment Bill for the protection of individuals of religious minority communities from neighbouring countries escaping persecution,” the 2019 manifesto had said.

The party also clarified that it would address the concerns of the locals in the northeastern states that had apprehensions regarding the legislation. There were widespread protests against the provisions of the law after Parliament passed it in December 2019. “We reiterate our commitment to protect the linguistic, cultural and social identity of the people of Northeast,” the manifesto had said.

In the wake of protests from minorities in India that perceived CAA and the proposed national register of citizens (NRC) to impinge on their rights and identity, the BJP led outreach campaigns to assuage fears that the new law will take away their rights.

“The implementation of the CAA was intended to help those minorities who had nowhere else to go, but could count on India as their natural homeland. Take for instance the Hindus in Pakistan and Bangladesh who have been at the receiving end of extremist policies and the Sikhs who had to flee Afghanistan after the Taliban take over,” said a functionary of the Rashtriya Swayamsevak Sangh (RSS), the ideological fount of the ruling BJP that has rallied support for the implementation of the law.

The Vishwa Hindu Parishad, an affiliate of the RSS, said that it will provide all help to refugees to complete the formalities of applying for citizenship. “This is in accord with the Indian tradition of giving refuge, respect and dignity to all those who suffer indignities outside and seek the shelter of Mother India,” its international working president Alok Kumar said.

While states such as West Bengal, Kerala, Madhya Pradesh (then under Congress rule), Punjab, Rajasthan and Tamil Nadu passed resolutions against the Act in 2019, on Monday West Bengal chief minister Mamata Banerjee said the notification of the rules is timed with the impending elections.

“This law was passed in 2020. After multiple extensions in four years, its implementation two to three days before the election announcement shows that it is being done for political reasons,” she said.

The Congress also linked the timing to elections. “It has taken four years and three months for the Modi Government to notify the rules for the Citizenship Amendment Act that was passed by the Parliament in December 2019. The Prime Minister claims that his Government works in a business-like and time-bound manner. The time taken to notify the rules for the CAA is yet another demonstration of the Prime Minister’s blatant lies,” Congressman Jairam Ramesh said in a post on X.

After seeking nine extensions for the notification of rules, the timing right before the elections is “evidently designed to polarise the elections, especially in West Bengal and Assam” and to manage the headlines after the Supreme Court’s severe strictures on the “Electoral Bonds Scandal.”

Electoral bonds: Supreme Court rejects SBI’s plea, orders it to furnish details tomorrow!

Electoral bonds: The Supreme Court also ordered the Election Commission to put the information released by SBI on its website by 5 pm on March 15.

New Delhi: The Supreme Court on Monday rejected the State Bank of India’s (SBI) plea seeking more time to furnish the details of electoral bonds to the Election Commission and ordered the country’s biggest bank to submit the same by the business hours of March 12, Tuesday. The apex court also ordered the poll panel to put the information on its website by 5 pm, March 15.

The court has warned the SBI chairman and managing director that they will face contempt proceedings if its order is not complied with within the timeline.

In a landmark verdict delivered on February 15, a five-judge Constitution bench scrapped the Centre’s electoral bonds scheme that allowed anonymous political funding, calling it “unconstitutional”.

The Supreme Court had ordered the SBI to disclose details on donors, the amount donated by them and the recipients, by March 13.

The SBI last week requested the court to extend the deadline for the disclosure of the details of the bond to June 30.

Today, a bench comprising CJI DY Chandrachud and justices Sanjiv Khanna, B R Gavai, J B Pardiwala and Manoj Misra, pulled up the bank, saying what was it doing over the last 26 days.

“In the last 26 days, what steps have you taken? Your application is silent on that,” the bench said.

The SBI has to just open the sealed cover, collate the details and give the information to the Election Commission, the bench added.

Senior advocate Harish Salve, appearing for the SBI, argued in the court that the bank needed more time to collate the details and match them as the information was kept in two different silos in its branches.

He further said the SBI would need at least three weeks to complete the exercise.

In response, the court said it only asked SBI to do a plain disclosure.

After SBI sought an extension of the deadline earlier this month, Congress chief Mallikarjun Kharge had said the BJP government was using the bank as a shield for its “dubious dealings”.

“The Modi government is using the largest bank of our country as a shield to hide its dubious dealings through Electoral Bonds… the BJP wants it to be done after the Lok Sabha elections. The tenure of this Lok Sabha will end on 16th June and SBI wants to share the data by 30th June,” Kharge had said.

Two election commissioners likely to be appointed on March 15: Report

Rajiv Kumar, the Chief Election Commissioner, is the only member of the poll authority currently. Anup Chandra Pandey retired on February 14 after reaching the age of 65 years.

Two election commissioners to be appointed on March 15

Two election commissioners are expected to be appointed by March 15, as per sources. These appointments are set to fill the vacancies left by the retirement of Anup Chandra Pandey and the sudden resignation of Arun Goel. Goel resigned on Friday morning, just days before the poll panel is likely to announce the Lok Sabha polls schedule. His resignation was accepted by President Droupadi Murmu on Saturday, which was followed by a formal announcement from the Law Ministry.

Rajiv Kumar, the Chief Election Commissioner, is the only member of the poll authority currently. Pandey retired on February 14 after reaching the age of 65 years.

A search committee led by Law Minister Arjun Ram Meghwal and including the Home Secretary and the Department of Personnel and Training (DoPT) Secretary is set to prepare two separate panels of five names each for two posts, as per sources who told news agency PTI.

Following this, a selection committee, chaired by the prime minister and including a Union minister and the Leader of the Congress party in the Lok Sabha, Adhir Ranjan Chowdhury, will choose two individuals for appointment as election commissioners. The President will make the final appointments.

According to sources, the selection committee may convene on either March 13 or 14, based on the members’ availability, with the appointments expected to be finalised by March 15.

Under the recently enforced law regarding the appointment of Chief Election Commissioner (CEC) and Election Commissioners (ECs), these positions were filled by the President based on government recommendations, with the senior-most typically taking up the role of CEC. This is in line with Clause 2 of Article 324 of the Constitution.

Amidst this, questions have arisen regarding the resignation of Goel, a senior official. Sources have indicated that personal reasons may have led to his decision, dismissing any suggestions of differences between Goel and Kumar. They highlighted that records of internal communication and decisions show no recorded dissent by Goel.

Goel, a 1985-batch Indian Administrative Service officer from the Punjab cadre, had joined the Election Commission in November 2022. His tenure was due to end on December 5, 2027, and he was expected to become the CEC following the retirement of the incumbent, Rajiv Kumar, in February next year.

Notably, Goel was absent from a critical meeting between the EC and top home ministry and railway officials regarding the deployment and movement of central forces across India for poll duty.

Real or AI? Kate Middleton’s photo pulled by agencies for being ‘manipulated

A photo of Kate Middleton and her children released by Kensington Palace for Mother’s Day has been pulled by several major news agencies amid concerns it may have been manipulated.

Kate Middleton
News agencies have taken down this photo of Princess of Wales Kate with her children for being “manipulated”.

In Short

  • Kensington Palace’s image of Kate Middleton and kids questioned for authenticity
  • Social media users suggested image appears edited or AI-generated
  • Major photo agencies withdraw images citing potential manipulation.

Several major news agencies have withdrawn an image distributed by Kensington Palace, featuring Kate Middleton and her children, amid claims that the photo has been manipulated.

On Sunday, the palace released a photo in celebration of Mother’s Day in the UK, showing the 42-year-old Princess of Wales smiling at the camera while her three children — Prince George, Princess Charlotte, and Prince Louis — stood around her. The palace stated that the photo was taken by Prince William, 41, earlier in the week at the family’s residence in Windsor.

However, users on social media questioned the authenticity of the image, with some suggesting that it appeared edited or generated by AI.

In response to these concerns, multiple photo agencies have decided to pull the image released by Kensington Palace.

The Associated Press noted upon closer inspection that “it appears that the source has manipulated the image.” Similarly, AFP withdrew the photo, citing “an editorial issue,” and instructed that it “may no longer be used in any manner” on online platforms.

Reuters picture editors pointed out a discrepancy in the alignment of the sleeve of Kate’s daughter’s cardigan, indicating potential alterations to the image.

This photograph marked the first officially released image of the princess since her abdominal surgery in January. Its release followed weeks of speculation and social media conspiracy theories surrounding her health and whereabouts.

Kensington Palace has yet to issue a statement on the controversy surrounding Kate Middleton’s photo.
